A questão dos investimentos internacionais à luz do Acordo de Paris de 2015 sobre mudanças climáticas

Abstract


A integração entre o direito internacional dos investimentos e os objetivos do Acordo de Paris permanece insuficiente. Apesar de o Acordo estabelecer metas claras para a redução das emissões e a ampliação do financiamento climático, os tratados bilaterais ainda priorizam a proteção do capital estrangeiro, em detrimento da soberania estatal e da preservação ambiental. Arbitragens internacionais com frequência restringem o espaço regulatório dos países anfitriões, comprometendo sua capacidade de implementar políticas climáticas mais eficazes. Nesse contexto, torna-se cada vez mais evidente a necessidade de redefinir as obrigações dos investidores e de fortalecer a autoridade regulatória dos Estados, de modo a compatibilizar os fluxos de capital com os princípios do desenvolvimento sustentável. Reformas recentes sinalizam uma possível convergência entre os dois regimes, mas avanços concretos ainda exigem mudanças normativas que garantam a coerência entre investimentos internacionais e a transição para uma economia de baixo carbono.
